Truth Tracker: Do we need laws preventing protesters from blocking hospitals?

TORONTO – Earlier this week, the Liberals and New Democrats promised to introduce a law that would make it illegal for protesters to block entry to hospitals, but legal experts say these laws already exist.

On Monday, several anti-vaccination and anti-lockdown rallies were held outside healthcare facilities across Canada, prompting widespread condemnation and promises from Liberal Leader Justin Trudeau and NDP Leader Jagmeet Singh to make this kind of activity illegal.

Richard Madan of CTV News spoke to several legal experts on Tuesday, who said the types of laws the Liberals and NDP promise already exist and it is governments and police who fail to enforce them.

Experts said possible charges could include assault, threats or mischief.

“We see it when someone is running on the field of a baseball game, they are dragged off the field and charged with mischief, because they interrupted that baseball game for everyone,” Daniel Brown, lawyer principal at Daniel Brown Law LLP in Toronto, told CTV News.

“It’s no different when you block the entrances to a hospital. You just can’t do that.
