Former President Trump’s legal team formally appealed the partial silence order issued Monday against him by the federal judge presiding over special prosecutor Jack Smith’s case related to January 6, 2021.
U.S. Judge Tanya Chutkan of the District of Columbia imposed a partial silence order against Trump on Monday, preventing him from making statements targeting Smith, his staff, potential witnesses and court staff.

Trump’s lawyers rejected the order Monday, arguing that by imposing partial silence, the court would “embrace new ground with respect to the First Amendment regulating campaign speech.”
“What will happen if Trump says something about Pence during the debate?” » asked Trump’s lawyer, John Lauro.
Former Vice President Mike Pence, also a 2024 Republican presidential candidate, could be called as a witness at the trial.
“It depends on what he says,” Chutkan responded, saying she was “not sure that without some sort of restriction” speech would be limited.
Chutkan said Monday that the former president was able to criticize the Justice Department in general terms and had the right to express his view that the cases against him were politically motivated. However, the judge said Trump could not publish attacks on prosecutors or court staff.
“No other defendant would be allowed to do this, and I will not allow it in this case,” Chutkan said, adding that, if necessary, she would impose sanctions if Trump violated the partial silence order.
