The decision of the Council of State awaited on the “sanitary pass” – RT in French

The Council of State has begun examining the appeal filed by the Quadrature du net which considers that the “health pass” unjustifiably discloses data on civil status and health. A decision is expected in the coming days.

According to Le Figaro, the Council of State began this June 22 the examination of the summary filed by the Quadrature du net against the “health pass” set up by the government, in order, according to the latter, to limit the risks of an epidemic resumption in the country. The association believes that this device violates the personal data of users and asks the highest administrative body to verify that this device complies with the law.

In its appeal of around thirty pages posted on its website and sent to the Council of State on June 11, the association considers that “the health passes issued contain […] information relating to the civil status of persons as well as their state of health […] which constitutes a serious and manifestly illegal interference with several fundamental freedoms, including the right to privacy and the right to protection of personal data ”.

La Quadrature du net also denounces the fact that holders of the health pass must prove their identity by presenting an identity card or a passport, therefore reserving access to major events to people with these documents.

A decision expected in the next few days

The association believes that “while, in practice, the possession of an identity card seems to be an obligation for many people, it is not in law”, drawing attention to the fact that “the possession of an identity card should not be imposed more than it is today, because this type of generalized registration risks having terrible consequences with the development of new technologies and the legalization of surveillance massive.

Entered into force on June 9, the “sanitary pass” is necessary to access major events that bring together more than 1,000 people. This tool available in digital format via the “TousAntiCovid” application or in paper format, allows its holder to prove his immunity, non-contamination or good recovery from Covid-19.

In this case, the Council of State could take longer than the usual two days to render its decision. As reported Le Figaro, the Ministry of Health announced that it opposed the association’s request without the details of the arguments being known.
