The health-social action federation of the CGT has just suffered a setback in the dispute between it and the Ministry of Health. Wednesday, November 25, the Council of State annulled, in summary, a decision of the administrative court of Paris, favorable to the union – the first within the hospital public service.
The dispute arose out of the “Ségur de la santé” – this agreement concluded on July 13 to revalue staff salaries. A committee and working groups have been created to monitor the application of the measures taken. The text provides that non-signatory organizations – such as the CGT Santé – do not participate. The federation seized the administrative judge to order the services of the Minister of Health of Olivier Véran to invite her to the meetings. The court gave him success, on October 23, by noting that the exclusion of the CGT brought “A serious and manifestly illegal interference with his freedom of association”.
But the Council of State considered that this was not the case. The groups from which the CGT is excluded are dedicated to “Only monitoring the progress of the implementation of the measures already provided for by [le Ségur] and compliance with the deadlines set by it ”. “Permanent concern for dialogue”
This decision is “Incomprehensible”, says Mireille Stivala, head of the CGTSanté. She said she was all the more amazed that the Council of State recently issued an order in favor of a union of doctors, not a signatory of Ségur, which was also asking for its integration into the groups in question.
