Prince Andrew calls for jury trial if Virginia Giuffre’s lawsuit isn’t thrown out

Prince Andrew wants a jury to decide a lawsuit brought by a sexual assault accuser if he cannot have the case dismissed outright, his lawyers said in court documents on Wednesday.

Virginia Giuffre, an American, has accused the British royal family of sexually assaulting her when she was 17 while traveling with financier Jeffrey Epstein. The request from Andrew’s attorneys was part of a formal line-by-line response to the lawsuit Giuffre filed against him in August in Manhattan federal court.

Andrew strenuously denied Giuffre’s allegations and attempted to have the trial dismissed. Earlier this month, Judge Lewis A. Kaplan rejected his bid for an early dismissal, allowing depositions and other evidence gathered by both sides to go forward.

Wednesday’s response was filed by Los Angeles attorneys Andrew Brettler and Melissa Lerner. They said the lawsuit should be dismissed on multiple grounds, again citing Giuffre’s permanent residence in Australia and a settlement more than a decade earlier between Epstein and Giuffre which Andrew’s lawyers say prevents him from pursue the prince. They also argued that she had consented to sexual activity and that the statute of limitations had expired.

Giuffre claimed she met Andrew when she traveled frequently with Epstein between 2000 and 2002, when her lawyers claimed she was “on call for Epstein for sexual purposes” and was “loaned to other powerful men”, including Andrew. Her lawsuit said she still suffered significant emotional and psychological distress and harm.

Following the judge’s ruling earlier in January, Prince Andrew – who had already stepped down from royal duties – was stripped of his honorary military titles.

Epstein, 66, killed himself in a federal prison in Manhattan in August 2019 while awaiting trial on sex trafficking charges. Giuffre has also made allegations against Ghislaine Maxwell, Epstein’s longtime girlfriend, but was not part of the criminal case that recently ended with Maxwell’s sex trafficking conviction.

The Associated Press generally does not identify people who say they are victims of sexual assault unless they choose to come forward publicly, as Giuffre has.
