Millions of credit card customers can get a share of $190m after data breach – deadline is within a week


AMERICANS now have a new deadline to file a lawsuit against Capital One for its 2019 customer data breach.

The deadline has been extended until September 30 to claim part of the $190 million data security settlement.

The original deadline to file a claim with Capital One was August 22, but it has since been extended until the end of the month, giving claimants just one week to file.

Capital One will pay $190 million to resolve claims it compromised customer data in 2019.

About 98 million Capital One customers are eligible because their information was compromised in the breach.

Their potential reward could be up to $25,000.

Compromised information

Capital One first told customers that millions of people had their information hacked when a third party hacked banking systems in July 2019.

This meant that information such as names, birth dates, addresses, phone numbers, credit scores, contact information, credit balances, payment history, and even social security numbers were accessible.

In a lawsuit, customers alleged that Capital One breached its duty to protect consumer information and failed to take reasonable cybersecurity measures to prevent the breach.

This exposes customers to identity theft and fraud, according to the lawsuit.

How much money can you receive?

Capital One did not accept full liability, but the company agreed to pay affected customers $190 million.

This amount will go to consumers in the form of cash payment for personal expenses and wasted time.

Reimbursement can be up to $25,000 in out-of-pocket costs related to the violation.

These expenses could include money spent to prevent identity theft and fraud, fraud fees, professional fees, and even up to 15 hours of lost time at a rate of at least $25 per hour.

How can you claim?

To secure payments for these expenses, Capital One customers must present detailed documentation, including bank statements, invoices and receipts.

The settlement also includes a three-year supply of identity defense services through Pango.

Pango provides dark web monitoring, identity monitoring, wallet loss protection, security freeze capabilities, million dollar insurance, among other offerings.

If customers have experienced fraud or identity theft as a result of the breach, Pango also offers free restoration services.

To prevent this type of breach from happening again, Capital One said it is committed to having extensive cybersecurity practices in place for at least the next two years.

Eligible customers can submit a claim by September 30 on Capital One’s website.

September also marks the deadline for several other direct payments, including in Ohio, Missouri and Colorado.

Several other states offered resident discounts in an effort to combat inflation.
