Donald Trump’s aide Kash Patel is set to testify before a grand jury investigating the handling of secret documents at Mar-a-Lago after being granted sweeping immunity from prosecution, according to a report.
Mr Patel, who worked in the Trump administration, will ‘soon testify’ before the federal grand jury The Wall Street Journal reported Wednesday evening.
In June, Mr. Trump named Mr. Patel as one of his official representatives to the National Archives and Records Administration.
When Mr. Patel appeared before the grand jury last October, Mr. Patel allegedly invoked his Fifth Amendment right against self-incrimination.
Mr Patel claimed Mr Trump declassified White House documents while still president.
“A federal judge recently ruled that the Justice Department could not compel Mr. Patel to testify without such protection from the use of his statements against him in future prosecutions,” the newspaper reported.
“This decision, the people said, opens the door for Mr. Patel, who says Mr. Trump largely declassified White House documents while still president, to answer questions.”
The grant of immunity means prosecutors could only charge Mr Patel with “information obtained independent of his immune testimony”, the newspaper reported.
The Federal Bureau of Investigation conducted a court-approved search Aug. 8 at the Mar-a-Lago estate, seizing more than 11,000 documents, at least 100 of which were classified as classified.
Mr. Patel was responsible for national security and defense during the Trump administration before becoming one of Mr. Trump’s delegates to interact with the National Archives and the Department of Justice.
The adviser claimed earlier that he had “personally witnessed” the 45th president declassifying files before leaving the presidency. “Upon leaving the White House, he issued new declassification orders declassifying entire sets of documents,” he told Fox News.
“He can literally stand over a set of documents and say they are now declassified and it is happening immediately with final action,” Mr Patel added.
