Johnny Depp’s account of a fight with Amber Heard in which his finger was severed has been disputed by an expert witness.
Dr Richard Moore, an orthopedic surgeon from Wilmington, North Carolina, told the court on Monday that Mr Depp’s account of the fight in which he says his finger was severed when Ms Heard threw a bottle of vodka is “not consistent with what we see”. in the described injury pattern or clinical photographs”.
The disputed bout took place in Australia in March 2015.
The defamation lawsuit between Mr. Depp and Ms. Heard began on Monday, April 11 in Fairfax, Va., following Mr. Depp’s lawsuit against his ex-wife in March 2019. Mr. Depp argues that she l libeled in a December 2018 op-ed published in The Washington Post titled “I spoke out against sexual violence – and faced the wrath of our culture. This must change”.
Ms Heard’s legal team asked hand surgeon Dr Moore if the finger injury “occurred as a result of a vodka bottle being thrown at him?”
He said he could see no evidence of damage to the nail that he would expect from an injury when the finger was hit by a bottle from above.
While Mr Depp claims his finger was cut by a vodka bottle thrown by Ms Heard, she testified he was injured when he smashed a phone against a wall.
Depp’s attorney, Camille Vasquez, noted that Mr. Depp said his finger was wrapped around the bar and the bottle hit him at an angle, not directly from above.
Dr Moore said in his written testimony: “I can’t rule anything out completely…I can’t rule out that the injury was caused by a car door…I can’t say for sure what caused it.” the injury “.
In her 2018 op-ed, Ms Heard wrote that “like many women, I had been harassed and sexually assaulted when I was of college age. But I kept silent – I didn’t expect the filing of complaints to do justice, and I didn’t see myself as a victim”.
“Then two years ago I became a public figure representing domestic violence, and I felt the full force of our culture’s anger for women speaking out,” she added to the time.
Although Mr. Depp is not named in the article, his legal team says it contains a “clear implication that Mr. Depp is a domestic abuser”, which they say is “categorically and patently untrue”. Mr Depp is seeking damages of “no less than $50 million”.
Ms. Heard has filed a $100 million counterclaim against Mr. Depp for nuisance and immunity from his claims.
What Johnny Depp said
Mr Depp testified to the alleged incident in turn as a witness last month.
Mr Depp alleged Ms Heard became ‘irritated’ during a discussion over a postnuptial agreement. “She couldn’t let go of the fact that I was a party to this postnuptial agreement and was trying to cheat her into basically getting nothing if anything were to happen,” Mr Depp said.
He said he told Ms Heard that was not his intention, but that the conversation degenerated into “madness”, “chaos” and “violence”.
“She was furious and she was possessed,” he said, adding that Ms Heard “pounded” him with “rough words”. “Forgive my language, but I remember it wasn’t nice to be called an a**-kisser by lawyers or an ap***y who didn’t fight for her or don’t fight for her. did not defend.”
Asked how his finger got hurt, Mr Depp said things were “all getting too crazy”. “I went behind the bar, I grabbed a bottle of vodka that was there and a shot glass,” he says. Mr Depp said he “paid [himself] two or three stiff shots of vodka”, which were “the first taste of alcohol [he’d] had for a long time”.
He alleged that Ms Heard, having found him at the bar, started yelling at him about his drinking. “She walked up to me and grabbed the vodka bottle, then kind of pulled back and threw it at me,” he said. “And it just went past my head and crashed behind me.”
Mr Depp said he grabbed another bottle, poured himself a glass and drank it. He alleged Ms Heard was hurling insults at him and grabbed that bottle and threw it at him. He alleged that the bottle “made contact” with him and “shattered all over”.
“I didn’t feel the pain at all at first,” he said. “I felt no pain. I felt warmth and felt like something was running down my hand. And then I looked down and realized that the tip of my finger had been cut, and I looked directly at my bones sticking out.
Mr Depp said ‘the blood was just flowing’.
“I think I kind of went into a — I don’t know what a nervous breakdown feels like, but that’s probably the closest I’ve ever been,” he said.
“Nothing made sense. I knew in my mind and in my heart, this is not life, this is not life. No one should have to go through this. And like I said , this feeling of being in the middle of a nervous breakdown, I started to write with my own blood on the walls little reminders of our past which were essentially lies that she had told me, and lies that I had caught her.
Mr Depp said he called his doctor and said: ‘You might want to come, I cut my finger here.’
Mr Depp said that once in the emergency room he told a doctor he had broken his finger in a door because he didn’t want to “get [Ms Heard] struggling.” “I didn’t want to put his name in that mix,” he said.
Mr Depp said that after the alleged incident, “for all intents and purposes, [he] just ended.
What Amber Heard Said
Ms Heard was asked about the incident, which allegedly took place in March 2015 (about a month after her marriage to Mr Depp), on the second day of her testimony (May 5).
Ms Heard said Mr Depp was ‘very upset’ about his work with Eddie Redmayne on The Danish Girl and other actors. She recounted a “belligerent” interaction with Mr. Depp that made her realize that “the arrows were pointed at [her] again”.
A physical altercation began, during which Ms Heard said Mr Depp ‘slammed me hard against the wall’ and called her names.
At one point, Ms Heard said Mr Depp threw her on a ping-pong table, climbed on top of her and punched her in the face repeatedly.
Ms. Heard was visibly upset as she continued her testimony. She said Mr. Depp hit her in a way that “sent [her] down to the ground”, and that when she got up, Mr. Depp threw a bottle in her direction. She said at one point he had a broken bottle next to his face and neck, and told him he would “cut [her] Face”.
Ms Heard said her memories of the night came to her in ‘flashes’. Eventually, she said, Mr. Depp was throwing bottles in her direction and she could “feel the glass breaking behind [her]and a bottle that went over her head, which left her “terrified.”
She said Mr. Depp ripped her nightgown from her chest and the nightgown eventually ripped off completely, leaving her naked.
She alleged that Mr Depp started hitting the wall next to her head and grabbing her by the neck. At one point, she said Mr Depp had found himself “above [her]”, telling him that she had “ruined [his] fucking life”.
“I couldn’t breathe, I couldn’t reach him, I couldn’t get up,” she said. “I don’t know how it ended. I don’t know how – I don’t know what happened next. Ms Heard sobbed as she continued: ‘Next thing I remember I was leaning back on the bar which means my chest was up. I looked at the blue light. My back is on the counter and I thought he was hitting me. I felt this pressure on my pubic bone. I thought he was hitting me. I could feel his arm moving and it felt like he was hitting me. But I could just feel that pressure.
Ms Heard said she remembered being still, not wanting to move, looking around the room and seeing broken bottles and shattered glass. “I remember not wanting to move because I didn’t know if it was broken — I didn’t know if the bottle he had inside me was broken,” she said. “I couldn’t feel it. I didn’t feel any pain. I didn’t feel any pain. I didn’t feel anything. … I looked around and saw so much broken glass. … I just remember thinking ‘Please God, please. I hope it’s not broken.
Ms Heard said she took sleeping pills and awoke to find Mr Depp “missing a finger”. “He kind of held it back,” she said. “And I said, ‘What did you do? When?’ And I realized in my head that it had probably been many hours since that happened.
Ms Heard suggested the cut could have happened when she said Mr Depp smashed a phone earlier.
