Accusations far from new

Accusations of “recasing” are recurrent in the Fifth Republic. Under Nicolas Sarkozy, criticism had fallen on the choice of the chief of staff of the Keeper of the Seals Michel Mercier for the sensitive post of Paris prosecutor: François Molins.

Another variant: under François Hollande, the choice of the former RPR minister Jacques Toubon for the post of Defender of Rights had offended the left… before especially bristling the right by his positions.

The power of the president

These controversies reflect the important power of appointment of the Head of State. The Constitution lists the main positions filled in the Council of Ministers, supplemented by an organic law.

In 2008, the constitutional revision desired by Nicolas Sarkozy established the approval by the competent committees of the two assemblies, of American inspiration, by means of a veto rule of 3/5ths, for around fifty positions, of the CEO of Aéroports de Paris to that of Météo France. But in nearly fifteen years of practice, no presidential proposal has been returned to sender.
