Alec Baldwin’s lawyers have appealed for a lawsuit against the actor for the fatal shooting on the set of his movie, Rust, to be dismissed.

The appeal relates to a lawsuit brought by screenwriter Mamie Mitchell, who alleges Baudouin fired a prop gun when it wasn’t in the script.

It was the second lawsuit against the actor following the death of the cinematographer Halyna Hutchinswhich was filmed on the Western movie’s set in Santa Fe, New Mexico in October.

Baldwin’s legal team said nothing in Ms Mitchell’s allegations suggested anyone knew the prop gun contained live ammunition leading up to the “unprecedented” incident.

“Nothing in the plaintiff’s allegations suggests that any of the defendants, including Mr. Baldwin, intended the prop gun to be loaded with live ammunition,” the attorneys said, in documents reported by US media.

“Furthermore, nothing in the plaintiff’s allegations suggests that any of the defendants knew that the prop gun contained live ammunition.

“The absence of such allegations is of course logical as the incident is apparently unprecedented in the film industry.”

Baldwin’s attorneys filed the submissions in Los Angeles Superior Court on Monday, Jan. 24, according to court documents.

When filing the complaint in November, Ms Mitchell’s lawyer, Gloria Allred, accused the actor of playing ‘Russian roulette’ when he fired the gun without checking it and without a gunsmith don’t do it in his presence.

The star is also facing another lawsuit from the film’s lighting chief, Serge Svetnoy, who claimed he was in “severe emotional distress” as a result of the incident.

In addition to Baldwin, the two lawsuits name nearly two dozen defendants associated with the film, including David Halls, the assistant director who gave the gun to the actor; and Hannah Gutierrez Reed, who was in charge of weapons on set.

Earlier in January, Baldwin shared a video on social media say claims that he is not complying with the shooting investigation are a “lie”.

In an on-camera interview with Good Morning America in December, his first since Ms Hutchins’ death, the actor said he didn’t feel guilty about the shootlike “someone is responsible for what happened and I can’t say who it is, but I know it’s not me”.

He also said he never pulled the trigger on the prop gunbut fired when he released the hammer – the mechanism that can be cocked before firing.
